WHICH SUPERIOR COURT PROVIDES THE CORRECT VENUE?

   If your legal matter needs to proceed to court, the question arises as to which Maricopa Countycourt location will hear your case.  If your legal matter involves a divorce or other family law matter, a probate matter, or a civil matter requesting the payment of damages or money due in excess of $10,000, or requesting specific directions from the court, then your case will be handled by a judge in one of the four Arizona superior courts located in Maricopa County. These courts are located in downtown Phoenix, the East Valley (Mesa), north Phoenix, and Surprise.

   The majority of cases are handled by the downtown Phoenix superior court location, followed by the East Valley, Mesa location (Southeast Judicial District).  Whether your case is assigned to the East Valley or the downtown  Phoenix location initially depends on the zip code of the attorney filing the action, for civil cases and probate matters, and for family law matters, the address of the petitioner is determinative.  However, The court rules allow for a plaintiff or petitioner to easily transfer their matter to another court. So, for instance, civil and probate matters initially filed by attorneys located in Tempe, Mesa, Guadalupe, Chandler, Queen Creek, Gilbert, Higley and Sun Lakes, will be assigned to the East Valley court.  For family law matters, those petitioners residing in Mesa, Chandler, Queen Creek, Gilbert, Higley and Sun Lakes, will be assigned to the East Valley superior court, while Tempe and Guadalupe residents will be assigned to the downtown Phoenix superior court, along with most Phoenix residents. Scottsdale residents are divided between the Northeast Judicial District Arizona Superior Court and the downtown Phoenix superior court.  The Northwest superior court also covers some Phoenix addresses.
